Please read these terms carefully before using WeShare. By accessing or using our platform, you agree to be bound by the terms and conditions described below.

These Terms of Service ("Terms") govern your access to and use of the WeShare platform, including our website, mobile applications, and all related services (collectively, the "Service"), operated by WeShare Inc. ("WeShare", "we", "our", or "us").

By creating an account or using our Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be legally bound by them. If you are using WeShare on behalf of a business, you represent that you have the authority to bind that business to these Terms.

Acceptance of Terms

By accessing or using WeShare in any way — including browsing listings, creating an account, listing an item, or making a booking — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use our Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

Description of Services

WeShare is a peer-to-peer rental marketplace that connects people who have items to share ("Hosts") with people who want to rent them ("Renters"). Our platform enables users to:

List items

Hosts can create listings for items they own and wish to rent out.

Book rentals

Renters can browse, request, and pay for items from Hosts.

Process payments

WeShare handles all financial transactions securely between parties.

Access protection

Insurance coverage and dispute resolution for eligible transactions.

WeShare acts as a marketplace intermediary only. We are not a party to the rental agreement between Hosts and Renters, and we do not own, control, or inspect any items listed on the platform.

User Accounts

Registration

  • You must be at least 18 years old to create an account.
  • You must provide accurate, complete, and current information during registration and keep it up to date.
  • You may only create one personal account. Business accounts are subject to separate terms.

Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at security@weshare.com if you suspect unauthorised access to your account.

Listings & Rentals

Host responsibilities

Hosts must ensure all listings are accurate, items are in good working condition, and that renting out the item does not violate any laws, insurance policies, or third-party agreements.

Renter responsibilities

Renters must use items only as intended, return them in the same condition as received, and comply with the Host's stated rules and restrictions.

Prohibited items

Weapons, illegal substances, counterfeit goods, and any items that are illegal to own or transfer in the applicable jurisdiction may not be listed on WeShare.

Booking confirmation

A rental agreement is formed only when a booking request is accepted by the Host and payment is confirmed by WeShare.

Rent-to-Buy

Our Rent-to-Buy feature allows rental fees to be credited toward the purchase price of an item if both parties agree. All Rent-to-Buy terms must be agreed upon within the platform before the rental begins.

Payments & Fees

Service Fees

WeShare charges a service fee on each completed transaction. Fees are displayed transparently before booking confirmation and are non-negotiable.

Renter fee

A percentage of the rental price, shown at checkout before payment.

Host fee

Deducted from the payout to cover payment processing and platform costs.

Payouts

  • Host payouts are released after the rental period begins, subject to any applicable hold periods.
  • Payouts are processed via the payment method on file and may take 3–5 business days to appear.
  • WeShare is not responsible for errors caused by inaccurate payout information provided by the Host.

Cancellations & Refunds

Cancellation policies are set by each Host and are displayed clearly on every listing before booking. By completing a booking, you agree to the Host's stated cancellation policy.

Flexible: Full refund if cancelled at least 24 hours before the rental start time.
Moderate: Full refund if cancelled at least 5 days before the rental start time.
Strict: 50% refund if cancelled at least 7 days before the rental start time. No refund thereafter.

WeShare service fees are non-refundable except where required by law or in cases where WeShare cancels a booking due to platform error.

User Conduct

You agree to use WeShare in a respectful, honest, and lawful manner. The following actions are strictly prohibited:

Post false, misleading, or fraudulent listings

Impersonate another person or entity

Use the platform for any illegal purpose

Harass, threaten, or intimidate other users

Circumvent WeShare to complete transactions off-platform

Scrape, crawl, or extract data from our platform without permission

Upload malware, viruses, or any harmful code

Attempt to gain unauthorised access to our systems

Violations of this section may result in immediate account suspension or termination, at WeShare's sole discretion, and may be reported to law enforcement where appropriate.

Intellectual Property

All content on the WeShare platform — including our logo, design, software, text, and graphics — is the property of WeShare Inc. and is protected by copyright, trademark, and other intellectual property laws.

By posting content on WeShare (such as listing photos or descriptions), you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content solely for the purpose of operating and promoting the platform.

You retain ownership of any content you submit. You represent that you have the right to post such content and that it does not infringe on any third-party rights.

Limitation of Liability

WeShare is a marketplace platform. We are not responsible for the actions, omissions, or conduct of any Host or Renter, or for the condition or suitability of any item listed on the platform.

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • To the maximum extent permitted by law, WeShare's total liability for any claim arising from your use of the Service shall not exceed the fees paid by you to WeShare in the 12 months preceding the claim.
  • WeShare is not liable for any indirect, incidental, special, consequential, or punitive damages.

Some jurisdictions do not allow exclusions of implied warranties or limitation of liability, so some of the above may not apply to you.

Termination

By you

You may close your account at any time by visiting your account settings. Termination does not affect any pending bookings, obligations, or amounts owed.

By WeShare

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms, is harmful to other users, or is otherwise deemed detrimental to the platform.

Effect of termination

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination — including liability, IP, and dispute resolution — will continue to apply.

Changes to Terms

We may update these Terms from time to time to reflect changes to our services, legal requirements, or business practices. When we make material changes, we will notify you by:

  • Sending an email to the address associated with your account, and
  • Posting a prominent notice on our platform.

Your continued use of WeShare after the effective date of updated Terms constitutes your acceptance of the changes. If you disagree with any changes, you should stop using the Service and close your account.
